This website is operated by The Spa Shop. Throughout the site, the terms “we”, “us” and “our” refer to The Spa Shop. The Spa Shop offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

These Terms constitute the entire agreement between you and us, superseding prior agreements. No waiver of any term shall be considered a continuing waiver.

SECTION 15 – INDEPENDENT BUSINESS RELATIONSHIP

We are an independent business operating as The Spa Shop. Although we are an approved retailer and repair agent for Hot Spring Spas New Zealand, we are not owned by, affiliated with, or a subsidiary of Watkins Wellness (U.S.A.), the global manufacturer of Hot Spring products. All product names, logos, and brands are property of their respective owners and are used for identification purposes only.

SECTION 16 – NEW ZEALAND CONSUMER GUARANTEES

Nothing in these Terms affects your rights under the Consumer Guarantees Act 1993 (CGA). If you are purchasing for personal, domestic, or household use, the CGA entitles you to guarantees that goods and services will:

Be of acceptable quality and fit for purpose
Match their description
Be repairable or refundable if they fail to meet these standards

If you are purchasing for business purposes, you agree that the CGA does not apply (as permitted under section 43 of the Act).

SECTION 17 – GOVERNING LAW

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
